The House and Senate reconvene this week with only four of the twelve fiscal year (FY) 2010 appropriations bills completed. With two weeks remaining before the year's first continuing resolution (CR) expires, Congress will likely be forced to pass a second CR, and the prospect of Democratic leaders drafting a year-end omnibus -- or "mini-bus" -- will increase as each week passes. Although the details of the next CR have not been finalized, the least controversial option would likely be a simple extension of the first CR, which expires on Oct. 31, 2009.

The Senate this week is scheduled to begin debate on the Medicare Physicians Fairness Act (S. 1776), legislation that would update the Medicare physician fee schedule beginning in 2010 as well as sunset the application of the sustainable growth rate formula.

"We have had a failed, flawed payment system in place for many years as it relates to physicians, and we come back every year, in fact, and stop the cuts that are proposed under that flawed system to make sure we are not putting our physicians in harm's way as it relates to their Medicare reimbursements," said Sen. Debbie Stabenow (D-MI) upon introducing the bill last week. "We all know that the sustainable growth rate process is flawed and yet we have not fixed it permanently. So the legislation I have would, in fact, fix this permanently and guarantee we are stopping this cycle that we put our physicians and hospitals through every year, where there may be a cut, there may not be a cut, and in the end we have to come in and fix it."

Stabenow acknowledged that the bill does come with a budgetary price tag, but did not provide specifics. The Congressional Budget Office has yet to release a cost estimate for the legislation.




The House this week is slated to take up the FY 2010 Coast Guard Authorization Act (H.R. 3619) and the Solar Technology Roadmap Act (H.R. 3585). The Coast Guard legislation would authorize a total of $9 billion in appropriations for the USCG, primarily for ongoing operations during FY 2010, while the solar technology bill would authorize $2.25 billion over five years for the Department of Energy (DOE) to support various programs related to solar energy technology, among other provisions. Other bills scheduled for House floor debate this week include:

  • H.R. 3763 - Amends the Fair Credit Reporting Act to provide for an exclusion from Red Flag Guidelines for certain businesses
  • H.R. 3819 - Extends the commercial space transportation liability regime
  • H.R. 3792 - Ryan White HIV/AIDS Treatment Extension Act
  • H.R. 3632 - Federal Judiciary Administrative Improvements Act
